1.1 asterandpage.co.uk is operated by L Square Enterprise Ltd, trading as Aster & Page ("we", "us", "our"). We are a company registered in England and Wales under company number 15857605, with our registered office at 3rd Floor, 86-90 Paul Street, London, England, United Kingdom, EC2A 4NE.
1.2 You can contact us at info@asterandpage.co.uk. When we say "in writing" in these terms, this includes email.
1.3 We are not registered for VAT.
2. These terms
2.1 These terms apply to every order you place with us through our website. Please read them before you order. By placing an order, you agree to them.
2.2 If you are buying as a consumer, you have legal rights in relation to products that are faulty or not as described. Nothing in these terms affects those rights. If you live outside the United Kingdom, you may also benefit from mandatory consumer protections under the law of your country, and nothing in these terms takes those away.
2.3 If you are buying as a business, clause 7 (changing your mind) and clause 8 (consumer rights if something is wrong) do not apply to you, and our total liability to you is limited to the price you paid for the product.
3. Our products
3.1 We describe and photograph our products as accurately as we can. Each copy is hand-assembled, so small variations in finish, colour and texture are normal and are not a defect. Colours may also appear slightly differently on your screen.
3.2 Limited editions. Where a product is described as a limited edition, we will not sell more than the stated number of copies in that edition. Edition numbers are allocated in the order that orders are confirmed. We cannot guarantee a particular number unless we have confirmed it to you in writing.
3.3 Please read the manual supplied with your product before use, and follow its guidance on charging, care and safe use.
4. Placing an order
4.1 Our website guides you through ordering. Before you submit your order, you can review it and correct any errors.
4.2 After you submit an order, we will email you to acknowledge it. This does not mean we have accepted it. Our acceptance takes place when we email you to confirm that your order has been dispatched, and the contract between us is formed at that point.
4.3 We may decline an order, for example if the product is unavailable, if we cannot deliver to your address, or if there is an obvious error in the price or description. If we decline an order after taking payment, we will refund you in full.
4.4 If we discover an obvious error in the price shown for a product, we will contact you before accepting your order, and you may choose to proceed at the correct price or cancel for a full refund.
5. Price and payment
5.1 Prices are shown in pounds sterling (GBP) on the product page at the time of your order. Delivery is added per order according to your destination. The product price and delivery charge include applicable import duties, VAT and other taxes for your delivery destination.
5.2 Delivery costs per order: UK complimentary, EU £10, US and Canada £20, and the rest of the world £30. The delivery charge and total shown at checkout when you place your order apply to that order. We cover all applicable import duties, VAT, taxes and customs handling charges for orders delivered worldwide. There is nothing further to pay on delivery for these charges. If a carrier requests payment on delivery, contact us before paying so that we can resolve it.
5.3 If you pay in a currency other than GBP, your card issuer or payment provider sets the exchange rate and may charge a fee. These are outside our control.
5.4 We take payment when you place your order.
6. Delivery
6.1 We deliver worldwide from our warehouse in the United Kingdom.
6.2 We will give you an estimated delivery date when you order, and a tracking link once your order is dispatched. Delivery times vary by country, and orders outside the UK must pass through customs, which can cause delays outside our control.
6.3 Delivery dates are estimates and we are not liable for delays caused by events outside our reasonable control, such as courier or customs delays. If a delay arises, we will let you know as soon as possible and take reasonable steps to minimise it. Nothing in this clause affects your statutory rights.
6.4 If delivery fails because nobody is available, the carrier will usually leave instructions for redelivery or collection. If an order is returned to us because of an incorrect address you provided, or because it was not collected, we will contact you to arrange redelivery, which may carry an additional charge.
6.5 The product becomes your responsibility, and you own it, once it is delivered to the address you gave us.
6.6 If your order arrives damaged, please let us know within 48 hours of delivery, with photographs if possible, so that we can resolve it quickly. This is a request to help us, not a condition: your rights under clause 8 apply regardless.
7. Your right to change your mind
7.1 If you are a consumer, you may cancel your order for any reason within 14 days of the day you, or someone you nominate, receive the product.
7.2 To cancel, email us at info@asterandpage.co.uk with your order number, the name and address on the order, and a clear statement that you wish to cancel. We will confirm by return and, if the product has already been delivered, tell you where and how to send it back.
7.3 You must then return the product to us within 14 days of telling us you wish to cancel, to the address we give you. Unless the product is faulty or not as described, you are responsible for the cost of returning it. Because our products contain a rechargeable lithium battery, some carriers restrict how they can be sent, particularly internationally. Please ask us before posting, and we will tell you how to return it safely.
7.4 We will refund the price you paid, including the standard delivery charge paid on your order, within 14 days of receiving the product back, or of receiving evidence that you have returned it, whichever is sooner. We refund using the payment method you used.
7.5 You may handle the product as you would in a shop to decide whether to keep it. If it has been handled beyond that, or is returned damaged, incomplete or without its packaging, we may reduce your refund to reflect its reduced value.
7.6 If you cancel before your order is dispatched, we will refund you in full.
8. If something is wrong with your product
8.1 We must supply products that are as described, of satisfactory quality and fit for purpose. If a product does not meet that standard, you have legal rights under the Consumer Rights Act 2015, which may include repair, replacement or a refund depending on the circumstances and how long you have had the item. Nothing in these terms affects those rights. For independent guidance, see Citizens Advice at citizensadvice.org.uk.
8.2 If you think your product is faulty or not as described, contact us at info@asterandpage.co.uk and we will put things right in line with your rights.
9. Our warranty
9.1 In addition to your legal rights, every product carries our 12-month warranty against manufacturing defects, running from the date of delivery.
9.2 The warranty does not cover damage caused by accident, misuse, water, exposure to heat, use of an unsuitable charger, or modification, nor normal wear to the battery over time.
9.3 You can register your product with us for warranty purposes, but registration is not required for the warranty to apply.
10. Our liability to you
10.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
10.2 We supply our products for domestic and private use only. If you use them for commercial or business purposes, we have no liability to you for loss of profit, business, or business opportunity.
10.3 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights as a consumer, or for anything else that cannot be limited or excluded by law.
11. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, including carrier or customs disruption, severe weather, industrial action, or changes in law. If such an event affects your order, we will contact you, and you may cancel for a refund of anything you have paid for products not yet received.
12. Your information
We use your personal information only as set out in our Privacy Policy.
13. Intellectual property
The Aster & Page name, logo, product designs, photography and website content belong to us or our licensors. You may not use them without our written permission.
14. Other important terms
14.1 We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens, and it will not affect your rights.
14.2 You may transfer your warranty to anyone who receives the product from you as a gift.
14.3 If a court finds part of these terms unlawful, the rest will continue in force.
14.4 If we delay enforcing any of these terms, we can still enforce them later.
14.5 Only you and we have rights under this contract. No other person can enforce it.
14.6 We may update these terms from time to time. The version in force when you placed your order applies to that order.
15. Complaints and governing law
15.1 If you have a complaint, please email info@asterandpage.co.uk. We aim to respond within five working days.
15.2 These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring them in your local courts. If you live outside the United Kingdom, you may also have the right to bring proceedings in your country of residence and to rely on the mandatory consumer laws there.
